The terms "Saunabodi," "we," "us," and "our" refer to Saunabodi Inc. Saunabodi operates this website and store, including all related information, content, features, tools, products and services offered through it (collectively, the "Services").

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service ("Terms"), together with any policies or additional terms referenced herein, describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They contain important information concerning your legal rights, including warranty disclaimers and limitations of liability.

By visiting, accessing, interacting with or purchasing through the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, do not access or use the Services.

SECTION 1 - ACCESS AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence.

To access certain features of the Services or purchase products, you may be asked to provide information including your name, email address, billing information, payment information and shipping address.

You represent and warrant that all information you provide is accurate, current and complete and that you have the right to provide that information.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.

You may not transfer, sell, assign or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to accurately display and describe our products through the Services. However, product colors, appearance, packaging and other visual characteristics may vary from what appears on your device or screen.

Product packaging, ingredients, descriptions, availability and other product information may change from time to time.

Always refer to the physical product packaging and label accompanying the product you receive for current ingredient, allergen, serving and usage information.

We reserve the right to discontinue products, modify products or limit quantities offered to any person, household, geographic region or jurisdiction, subject to applicable law.

Products purchased through the Services are intended for personal or household use unless otherwise expressly agreed by Saunabodi.

SECTION 3 - DIETARY SUPPLEMENTS AND HEALTH INFORMATION

Certain Saunabodi products are dietary supplements.

Information provided through the Services, including information concerning ingredients, nutrition, hydration, electrolytes, exercise, heat exposure, wellness, performance and recovery, is provided for general informational and educational purposes only.

It is not intended to provide individualized medical advice, diagnosis or treatment or to replace advice from a qualified healthcare professional.

Saunabodi dietary supplements are not intended to diagnose, treat, cure or prevent any disease.

Individual nutritional, hydration, fluid and electrolyte requirements vary. You are responsible for using our products according to their labels and considering your individual circumstances.

If you have a medical condition, take medication, are pregnant or nursing, have been advised to monitor your sodium, electrolyte or fluid intake, or have questions about whether a Saunabodi product is appropriate for you, consult an appropriate qualified healthcare professional before use.

Discontinue use and seek appropriate medical advice if you experience an adverse reaction.

Do not consume a product if its packaging or individual stick packs appear opened, damaged, tampered with or otherwise compromised.

SECTION 4 - ORDERS

When you place an order, you are making an offer to purchase.

Saunabodi reserves the right to accept or decline an order, subject to applicable law. Your order is accepted when we confirm acceptance and successfully process payment.

Please review your products, quantities, purchase option and shipping information carefully before submitting your order.

If you need to modify or cancel an order, contact us as quickly as possible at support@saunabodi.com. We will make reasonable efforts to accommodate your request before the order enters fulfillment, but we cannot guarantee that an order can be modified or cancelled once processing has begun.

We may limit or cancel quantities purchased per person, household, account, payment method or order where we reasonably believe an order involves fraud, unauthorized resale, abuse of a promotion or other misuse of the Services.

Purchases made through the Services are intended for personal or household use and not for unauthorized commercial resale or export.

Purchases are subject to our Shipping, Returns & Refunds Policy.

SECTION 5 - PRICES, BILLING AND PAYMENT

Prices, discounts and promotions are subject to change.

The price charged for a one-time purchase will generally be the price displayed when your order is submitted, subject to correction of errors as permitted by law.

Unless expressly stated otherwise, displayed product prices do not include applicable taxes, shipping or handling charges.

You agree to provide current, complete and accurate billing, payment and account information and to promptly update information necessary for us to process transactions and communicate with you.

You represent and warrant that you are authorized to use any payment method submitted through the Services.

Prices available through Saunabodi.com may differ from prices offered by third-party retailers.

Promotional offers may be subject to separate terms. If specific promotional terms conflict with these Terms, the terms expressly applicable to that promotion will govern with respect to the promotion.

SECTION 6 - SHIPPING AND DELIVERY

Saunabodi currently ships to eligible addresses within the United States as described in our Shipping, Returns & Refunds Policy.

Delivery dates and transit times are estimates and are not guaranteed.

Delivery may be affected by shipping carriers, weather, holidays, incorrect or incomplete address information, remote destinations and circumstances outside our reasonable control.

Customers are responsible for providing complete and accurate delivery information.

If your order is delayed, damaged, lost, incomplete, incorrect or returned to sender, please contact us at support@saunabodi.com.

Eligibility for replacement or refund will be determined in accordance with our Shipping, Returns & Refunds Policy and applicable law.

Our Shipping, Returns & Refunds Policy is incorporated into and forms part of these Terms.

SECTION 7 - SUBSCRIPTIONS AND AUTOMATIC RENEWAL

7.1 Subscription Purchases

Saunabodi may offer eligible products through recurring subscription purchase options.

By purchasing a subscription, you authorize Saunabodi and its payment service providers to automatically process recurring orders and charge your selected payment method according to the pricing and delivery frequency disclosed when you enroll, until you cancel your subscription.

Saunabodi subscriptions have no minimum purchase commitment unless a specific offer expressly states otherwise before purchase.

7.2 Subscribe & Save

Customers enrolled in our standard Subscribe & Save program may receive 15% off eligible recurring subscription purchases, unless a different offer or promotion expressly states otherwise.

Available delivery frequencies will be displayed before enrollment and may include delivery every 30, 45 or 60 days or other frequencies made available through the Services.

7.3 New Subscriber Promotional Offer

Eligible new subscribers may be offered 50% off their first qualifying subscription order.

Unless expressly stated otherwise with the applicable promotion:

  • The introductory 50% discount applies only to the first eligible subscription order.

  • Subsequent eligible recurring orders receive the standard subscription discount, currently 15% off the applicable regular product price.

  • The subscription automatically continues at the customer's selected delivery frequency until cancelled.

  • There is no minimum purchase commitment.

  • The customer may cancel the subscription at any time in accordance with these Terms.

Eligibility requirements, redemption limits, product restrictions and other promotional conditions may apply and will be disclosed with the applicable offer.

7.4 Recurring Charges

By enrolling in a subscription, you expressly authorize Saunabodi and its payment service providers to automatically charge your selected payment method for each recurring subscription order, including applicable taxes, shipping charges and other amounts disclosed in connection with your subscription.

Your subscription will continue automatically until cancelled.

You are responsible for maintaining current and accurate payment, billing, shipping and account information.

7.5 Managing Your Subscription

Subject to availability and applicable processing deadlines, you may use your online subscription account to:

  • Change your delivery frequency;

  • Skip an upcoming delivery;

  • Pause your subscription;

  • Modify eligible products, flavors or quantities;

  • Update eligible account, shipping or payment information; or

  • Cancel your subscription.

Changes should be made before your next subscription order enters processing.

7.6 Cancellation

You may cancel your Saunabodi subscription at any time. There is no minimum subscription commitment.

Cancellation stops eligible future recurring subscription orders and charges.

Cancellation does not automatically cancel or refund an order that has already entered processing.

To avoid your next recurring charge, cancel your subscription before your next order is processed.

Online subscriptions may be cancelled through the subscription management functionality available through your account.

7.7 Processed Subscription Orders

Once a recurring order has entered fulfillment, we may be unable to cancel or modify it.

Cancelling a subscription and requesting a refund for an order are separate actions.

Eligibility for a refund relating to an order that has already been processed is governed by our Shipping, Returns & Refunds Policy.

7.8 Failed Payments

If we are unable to process a recurring payment, we or our payment provider may attempt the payment again and may contact you to update your payment information.

We may pause or cancel a subscription following unsuccessful payment attempts.

7.9 Subscription Price Changes

Subscription pricing and discounts may change from time to time.

If a change affects the amount you will be charged for future recurring subscription orders, we will provide advance notice as required by applicable law before the change takes effect and provide information concerning how to manage or cancel your subscription.

Additional terms presented to you when enrolling in or modifying a subscription form part of your agreement with Saunabodi.

SECTION 8 - 45-DAY SATISFACTION GUARANTEE, RETURNS AND REFUNDS

Eligible first purchases made directly through Saunabodi.com may qualify for our 45-Day Satisfaction Guarantee.

The Satisfaction Guarantee is subject to the eligibility requirements, limitations and claim procedures contained in our Shipping, Returns & Refunds Policy.

Unless otherwise expressly stated in that policy, the Satisfaction Guarantee is limited to one qualifying claim per customer or household and does not restart with each recurring subscription delivery.

Because Saunabodi dietary supplements are ingestible products, do not mail opened supplements back to us unless specifically instructed to do so by Saunabodi Customer Support.

Cancelling a subscription does not automatically create a refund for an order that has already been processed.

Our Shipping, Returns & Refunds Policy governs eligibility for returns, replacements and refunds and is incorporated into these Terms.

SECTION 9 - PROMOTIONS AND DISCOUNTS

Saunabodi may periodically offer discounts, promotional pricing, gifts, introductory offers, referral incentives or other promotions.

Promotions may be subject to eligibility requirements, purchase requirements, product exclusions, redemption limits, expiration dates and other conditions disclosed with the applicable promotion.

Unless expressly stated otherwise:

  • Promotional offers cannot be combined;

  • Promotional discounts have no cash value;

  • Promotions apply only during the stated promotional period; and

  • We may limit promotions to one redemption per customer, household, account, payment method or shipping address.

We reserve the right to refuse, cancel or reverse a promotional transaction where we reasonably determine that a promotion has been used fraudulently, abusively or contrary to its stated terms, subject to applicable law.

Where promotional pricing applies only to the first order of an automatically renewing subscription, the pricing applicable to subsequent recurring orders will be disclosed before enrollment.

SECTION 10 - INTELLECTUAL PROPERTY

The Services, including trademarks, trade names, logos, text, displays, graphics, photographs, product imagery, video, audio, website design and the selection and arrangement thereof, are owned by Saunabodi, its affiliates or licensors and are protected by applicable U.S. and international intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes only.

Except as permitted by applicable law or with our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell or exploit material contained within the Services.

Nothing in these Terms grants you any license or other right to use Saunabodi's intellectual property except as expressly provided.

Saunabodi's names, logos, product names, designs and slogans are trademarks of Saunabodi or its affiliates or licensors and may not be used without prior written permission.

Shopify's names, logos, product names, designs and slogans are trademarks of Shopify. Other trademarks appearing through the Services belong to their respective owners.

SECTION 11 - OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, features or functionality offered by third parties.

Except as otherwise expressly stated, we do not control such third-party tools and provide access to them on an "as is" and "as available" basis.

Your use of third-party tools is subject to the applicable third party's terms and policies.

We may introduce new features, tools and resources through the Services from time to time. Unless otherwise stated, such features form part of the Services and are subject to these Terms.

SECTION 12 - THIRD-PARTY LINKS

The Services may contain links to websites, content, services or functionality operated by third parties.

We are not responsible for evaluating or guaranteeing the content, accuracy, products, services, security or practices of third-party websites.

If you leave the Services to access a third-party website or service, you do so subject to the applicable third party's terms and policies.

Complaints, claims or questions concerning third-party products or services should be directed to the applicable third party.

SECTION 13 - RELATIONSHIP WITH SHOPIFY

Saunabodi is powered by Shopify, which enables us to provide the Services to you.

However, sales and purchases made through our store are transactions directly between you and Saunabodi.

By using the Services, you acknowledge that Shopify is not responsible for any aspect of a sale between you and Saunabodi, including injury, damage or loss resulting from products or services purchased from Saunabodi.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages and liabilities arising from or relating to purchases and transactions between you and Saunabodi.

SECTION 14 - PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify may collect and process certain personal information relating to your access to and use of the Services in order to provide and improve the platform and related services.

Information submitted through the Services may also be transmitted to and processed by service providers and other third parties involved in providing the Services, potentially including parties located outside your state or country.

Please review our Privacy Policy for additional information about how personal information is collected, used, disclosed and protected.

SECTION 15 - FEEDBACK, REVIEWS AND USER CONTENT

If you submit, upload, post, email or otherwise provide ideas, suggestions, feedback, reviews, photographs, proposals or other content ("Feedback"), you grant Saunabodi a non-exclusive, perpetual, worldwide, sublicensable and royalty-free license to use, reproduce, modify, publish, distribute and display that Feedback for purposes including operating, improving and promoting the Services, subject to applicable law.

You represent that you own or have the necessary rights to submit your Feedback and that your Feedback does not violate the rights of another person or applicable law.

Where required, you are responsible for disclosing compensation, free products or other incentives received in connection with Feedback or reviews.

We may monitor, edit or remove Feedback that we reasonably determine violates these Terms or applicable law.

You remain responsible for the accuracy and content of Feedback you submit.

SECTION 16 - ERRORS, INACCURACIES AND OMISSIONS

Information available through the Services may occasionally contain typographical errors, inaccuracies or omissions concerning product descriptions, pricing, promotions, availability, shipping charges or transit times.

Subject to applicable law, we reserve the right to correct errors or inaccuracies, update information and cancel or modify affected orders where information was materially inaccurate.

SECTION 17 - PROHIBITED USES

You may access and use the Services only for lawful purposes.

You may not use the Services to:

  • Violate applicable laws or regulations;

  • Infringe our intellectual property rights or the rights of another person;

  • Harass, threaten, abuse, defame or harm another person;

  • Transmit false, fraudulent or misleading information;

  • Distribute malware, viruses, spam, phishing attempts or malicious code;

  • Impersonate another person or entity;

  • Collect personal information about others without authorization;

  • Circumvent security, access-control or anti-abuse measures;

  • Scrape, extract, reproduce, sell or commercially exploit the Services or their content without authorization; or

  • Engage in conduct that materially interferes with the Services or another person's use of them.

We reserve the right to restrict, suspend or terminate access to the Services where we reasonably determine these Terms have been violated.

SECTION 18 - AUTOMATED AGENTS

If software or an automated or semi-automated service ("Agent") accesses or interacts with the Services on behalf of a person or entity, the Agent must comply with these Terms and applicable technical access requirements.

We may limit or prevent automated access to the Services, including through technical measures.

Agents may not circumvent CAPTCHAs, access restrictions, security measures, robot exclusion mechanisms or other measures intended to control automated access.

SECTION 19 - TERMINATION

We may suspend or terminate your access to the Services where permitted by applicable law, including where we reasonably believe you have violated these Terms, engaged in fraudulent activity or misused the Services.

You remain responsible for amounts properly due for purchases made before termination.

Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, Feedback, disclaimers, limitation of liability, indemnification and governing law.

SECTION 20 - DISCLAIMER OF WARRANTIES

Information presented through the Services is provided for general informational purposes.

Except as expressly stated by Saunabodi and to the fullest extent permitted by applicable law, the Services and products offered through the Services are provided "as is" and "as available," without warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not guarantee that use of the Services will be uninterrupted, timely, secure or error-free.

We do not guarantee that any particular individual will experience a specific hydration, recovery, health, wellness or performance outcome from using a Saunabodi product.

Individual experiences may vary based on factors including diet, activity, sweat rate, environment, health status, product usage and other individual circumstances.

Some jurisdictions do not permit certain warranty exclusions or limitations. Nothing in these Terms excludes or limits any warranty, right or remedy that cannot lawfully be excluded or limited.

SECTION 21 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAUNABODI INC., ITS AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR SIMILAR DAMAGES, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THE FOREGOING LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES OR LIABILITIES. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

SECTION 22 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend and hold harmless Saunabodi Inc., Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from third-party claims, losses, damages, liabilities and reasonable attorneys' fees arising from:

  1. Your material breach of these Terms or policies incorporated into them;

  2. Your violation of applicable law or the rights of a third party; or

  3. Your unlawful or unauthorized use of the Services.

We will provide reasonable notice of an indemnifiable claim and may control its defense and settlement, provided that we will not impose non-monetary obligations on you through settlement without your consent, which will not be unreasonably withheld.

SECTION 23 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

SECTION 24 - WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with policies, subscription disclosures, promotional terms and other operating rules expressly incorporated by reference, constitute the agreement between you and Saunabodi concerning your use of the Services and supersede prior agreements or communications concerning the same subject matter.

SECTION 25 - ASSIGNMENT

You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent.

We may assign or transfer these Terms and our rights and obligations in connection with a merger, acquisition, financing, corporate reorganization, sale of assets or other lawful business transaction, subject to applicable law.

SECTION 26 - GOVERNING LAW

These Terms and any dispute arising from or relating to these Terms or the Services will be governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except to the extent applicable federal law or the mandatory consumer-protection laws of your state of residence provide otherwise.

Subject to any rights you may have under applicable law, legal proceedings relating to these Terms or the Services may be brought in the state or federal courts having jurisdiction in Delaware.

Nothing in this section deprives a consumer of any protection or right that cannot lawfully be waived under applicable law.

Section headings are provided for convenience and do not limit or otherwise affect the interpretation of these Terms.

SECTION 28 - CHANGES TO THESE TERMS

You may review the current version of these Terms at any time through the Services.

We may update these Terms from time to time.

Where required by applicable law, we will provide notice of material changes and specify when those changes become effective.

Changes to recurring subscription pricing, billing or other material subscription terms will be communicated in accordance with applicable law.

Your continued use of the Services following the effective date of updated Terms constitutes acceptance of those Terms to the extent permitted by applicable law.
